Misclassification of Independent Contractors: The Potholes Are Getting Deeper
Jerry Lutkus, Barnes & Thornburg
Federal and state authorities have identified misclassification of employees as independent contractors as an example of “wage theft”. The U.S. Department of Labor has even suggested that 70% of workers identified as Independent Contractors are classified incorrectly. Recently the National Labor Relations Board concluded that in certain circumstances misclassification can be an unfair labor practice. We’ll take a look at the current status of the Independent Contractor status and offer some practical suggestions on how to deal with this issue.

It’s Not as FAR as You Think
Tim Maher, Barnes & Thornburg
The increased demand for next-day delivery has moved many vendors directly or indirectly into air freight operations which are governed by the Federal Aviation Regulations (FAR). Lack of familiarity with FAR requirements can result in an uncomfortable encounter with the FAA, which has discretion to impose significant fines. Understanding how and when you or your customers will be subject to FAR can help you avoid these problems. We will discuss FAR’s applicability and what to do if you receive a Notice of Proposed Civil Penalty from the FAA.

Cybersecurity for Logistics and Transportation: Attacks, Defenses and Risk Transfer
Jason Bernstein, Barnes & Thornburg
Jason will cover: Trends in types of attacks, How to protect against attacks and defend when an attack occurs, Managing and transferring liability and risk in vendor and customer agreements, Preparation: Developing cybersecurity policies and a response plan and Cyber insurance.

Non-competes, Restrictive Covenants and Trade Secrets: Are You Covered?
David Ritter, Barnes & Thornburg
David Ritter will discuss current trends and pitfalls in non-competes and restrictive covenants. Come and learn how your agreements, policies and procedures stack up.

Get Ready for Your Worst Nightmare
