John Moye is an effective communicator and a proactive problem-solver who takes pride in devising creative solutions to help resolve his client’s disputes. OVERVIEW

John helps his clients navigate complex business disputes, and, when litigation arises, he vigorously represents them in federal and state court proceedings throughout the United States, as well as in commercial arbitration proceedings. He has successfully handled a number of large, complex litigation matters, including a federal lawsuit against a manufacturer of alloy castings for the automobile industry, a complex lawsuit involving a large software implementation at a publicly traded clinical research organization, a number of lawsuits involving the theft of company trade secrets, and various matters for an Atlanta-based manufacturer and distributor of industrial cleaning supplies.

Prior to joining Barnes & Thornburg, John practiced law for over a decade with an AmLaw 100 firm, working in both Atlanta and the Research Triangle in North Carolina. He is admitted in both Georgia and North Carolina and has handled a number of litigation matters in both jurisdictions.

John has also participated in a number of pro bono matters throughout his career, including handling a range of dispossessory cases though the Atlanta Volunteer Lawyers Foundation and representing a number of detained immigrants in federal asylum proceedings. In 2017, he received the “Volunteer Lawyer of the Year” award from the Georgia Immigration and Asylum Network (GAIN).

John has published articles on telecommunications law issues, trade secrets, the Computer Fraud and Abuse Act, employee and vendor non-disclosure and confidentiality agreements, employment best practices, and cybersecurity. He has also presented at conferences and continuing legal education events, including the ITechLaw Conference, and, from 2011 to 2015 taught a civil litigation course at the University of North Carolina School of Law.

Before law school, John taught English at Xavier High School, the oldest Jesuit high school in New York City, and worked as a reporter for Forbes magazine, where he wrote about technology issues, startups and entrepreneurs.

Served as lead counsel in a 5-day jury trial, and prevailed on all claims that were pending, on behalf of an Ohio-based manufacturer of alloy castings in federal case involving alleged breaches of a profit-sharing agreement, disputes over intellectual property ownership and various tort claims
Presently serve as lead counsel for a publicly traded clinical research organization in a complex software implementation dispute that is pending in the North Carolina Business Court
Served as counsel to North Carolina-based mortgage lending company in various disputes in Kentucky arising out of alleged theft of trade secrets and violation of non-competition provisions, including concurrent proceedings in federal court and before the AAA
Served as counsel to Atlanta-based art dealer in contractual dispute arising out of distribution of commissions from art transactions
Obtained summary judgment and a dismissal of all claims in the representation of a large telecommunications provider in dispute brought by a hardware vendor alleging claims for business defamation, unfair trade practices, and other torts
Represented large global adhesive manufacturer in the U.S. District Court for the Eastern District of North Carolina in a case involving a former employee’s misappropriation of trade secrets and intellectual property
Obtained a verdict granting ownership of all related patents for a software company that conducts research and invents patentable technologies in the field of wireless technologies, following a three-week jury trial in the North Carolina Business Court, regarding a dispute with a former employee-inventor over the ownership of certain patents
Represented large telecommunications provider in federal lawsuit brought by a number of rural telecommunications companies located in the Carolinas, arising out of the provision of “Long Term Evolution” wireless technology
Represented Atlanta-based company that provides SEC consulting services in lawsuit against former employees and officers, involving concurrent litigations regarding theft of trade secrets, breach of restrictive covenants and unfair competition in the Northern District of Georgia, the District of New Jersey and an arbitration before the AAA in New York
