Mark litigates for large national and international businesses and Fortune 200 companies across many industries, including software, automotive, biopharma, domestic and overseas manufacturing, consumer products and home goods. His 20-year stint as national product liability counsel, managing local counsel and trying cases nationwide for a large heavy-equipment manufacturer gives him a unique understanding of in-house counsel’s needs, priorities and objectives. Clients value Mark’s drive to win, legal intelligence, creative approaches and ability to read opposing counsel. Mark is a deeply experienced and versatile negotiator and advocate. Because of his experience resolving disputes, Mark frequently advises clients on proactive strategies to diminish their liability and prevent disputes from arising.

Mark devotes a portion of his practice assisting clients in complying with government agencies regulating the manufacturing, sale and labelling of industrial and consumer products. Domestically, this includes the Consumer Product Safety Commission, the National Highway Transportation Safety Authority, the Food and Drug Administration, the Federal Trade Commission, the Federal Communications Commission, Proposition 65, and Toxics in Packaging. Internationally, Mark’s experience includes the Product Safety, REACH, ROHS, WEEE, and ELV directives enacted by the European Union and other countries.

  • Successfully resolved a $27 million dollar lawsuit for breach of a franchise and distribution agreement after obtaining summary judgment on the client’s counterclaim for damages arising out of the defendant’s violation of the forum selection clausE
  • Obtained summary judgment on behalf of an industrial equipment manufacturer in a $42 million dollar lawsuit arising out of the destruction of large steel-making facility
  • Successfully defended an international hotel chain in a multinational dispute concerning a multimillion dollar commission claim arising out of the construction of hotel in Milan, Italy
  • Obtained the dismissal of a series of lawsuits against an international hotel chain arising out of a terrorist bombing of a hotel in Amman, Jordan
  • Successfully resolved multi-district class action litigation against a lock manufacturing client arising out of its marketing of lock products
  • Successfully resolved an arbitration action in Seattle on behalf of Japanese customer service centers against a U.S. vendor

  • Advised many clients on issues relating to potential duty to report to the Consumer Product Safety Commission, Health Canada, and National Highway Transportation Safety Agency, and guided the client through related recalls

  • Successfully pursued a claim on behalf of a vehicle manufacturer against a component supplier for the sale of non-conforming component parts
