Mark's multifaceted practice includes legal solutions for general industry, industrial hygiene, and construction issues. Whether Mark is advising on a catastrophe or fatality situation or another scenario that is less severe, he provides scalable legal support tailored to each client's unique needs. Notably, Mark is effective at working with health and safety professionals and in-house counsel alike to realize his client’s best possible outcome.
Mark's proactive approach to OSHA counseling includes mandatory reporting for fatalities, overnight hospitalizations or amputations, representing clients during onsite OSHA inspections, conducting damage assessments, and negotiating settlements through the informal conference process, as well as representing clients in formal administrative appeals and hearings. Mark understands, from decades of first-hand and practical experience, that working with counsel before reporting may be the difference between an onsite inspection or merely a written request for information.
Beyond OSHA matters, Mark defends clients in federal and state litigation involving discriminatory practices and retaliation claims. His experience also includes actionable legal solutions to Title VII, ADA, ADEA, FMLA, and ERISA-related challenges. Moreover, Mark advises and litigates the enforcement of restrictive covenants and trade secret misappropriation claims on behalf of his clients.
