Joshua Rosenberg has extensive experience in insurance practice, devoting himself to advising and representing publicly and privately owned corporations in disputes with their insurance companies. Joshua provides corporate policyholders with a keen understanding of how insurance companies work, applying his knowledge of their pressure points to achieve client objectives.

Joshua Rosenberg has extensive experience in insurance practice, devoting himself to advising and representing publicly and privately owned corporations in disputes with their insurance companies. Joshua provides corporate policyholders with a keen understanding of how insurance companies work, applying his knowledge of their pressure points to achieve client objectives.

Joshua represents corporate policyholders in litigation and arbitration matters throughout the country and abroad involving directors’ and officers’ liability, healthcare professional liability and errors and omissions liability insurance, crime coverage, commercial general liability coverage, cyber insurance, and rights of additional insureds. Joshua regularly works on high-stakes claims in a wide range of industries, including healthcare, technology, banking and finance, construction and design, real estate and many more. Joshua also counsels his clients throughout the claim process, well before litigation or arbitration, to help them maximize their insurance assets.

Insurance companies have armies of lawyers ready to fight claims made by corporate policyholders. Joshua and his team of coverage attorneys and other professionals are the force multiplier that can help level the playing field. Having successfully prosecuted insurance cases throughout the United States and abroad, Joshua understands the importance of resolving insurance coverage disputes without going to war wherever possible, as well as the fact that sometimes, litigation is the only option.

His reputation for aggressive advocacy in negotiations, coupled with his team’s ability to litigate against insurance companies, underscores for carriers the risks and costs of not trying to resolve a claim informally.

During law school, Joshua served as a judicial extern for the Honorable Dana M. Sabraw of the U.S. District Court for the Southern District of California.

  • Represented nationwide hospital management company in Tennessee and Texas litigation seeking coverage under professional liability insurance program for settlement of a DOJ investigation under the False Claims Act and related qui tam action, securing a favorable settlement
  • Represented a global technology company in recovering over $100 million in coverage from multiple insurers in a technology errors and omissions insurance tower, including a published opinion in SDNY action against three of these insurers 
  • Recovered $98 million from a tower of insurers to fund a settlement of a professional liability claim for a global commercial real estate company sued for secondary liability arising from a Ponzi scheme to which it was not a part
  • Represented a large operator of acute care hospitals in Delaware and New Mexico litigation, and a Bermuda arbitration, brought by insurers seeking to defeat coverage under a healthcare professional liability tower arising from a $73.21 million jury verdict, winning a favorable settlement
  • Recovered $60 million for a large operator of acute care hospitals from a tower of insurers to fund a settlement of securities and derivative actions
  • For a financial institution subsidiary of the largest bank in Canada, recovered $4.5 million paid to settle a lender liability claim
  • Represented a global data security firm in a policy rescission action brought by a carrier, based on alleged misrepresentations in the insurance application, and won a favorable unpublished decision from the Ninth Circuit that drove an ultimate settlement of the case 
  • Represented a national telecommunications provider in recovering a $10 million claim without litigation and with apology from the insurer for denying coverage
  • Secured coverage for a $30 million settlement of a personal injury action from multiple insurers for a national staffing agency
  • Assisted Chapter 11 Plan Administrator evaluate claim under buyer-side representations and warranties insurance policy
