Linda advises clients on commodity jurisdiction, export classification, licensing, technical assistance agreements, and enforcement matters related to defense articles and dual-use items, as well as encryption software and technical data and services. Her experience extends to a range of industries, including aerospace, satellite, nuclear, electronics, defense, security, and software, among others. She also represents clients in export control matters elevated to the inter-agency Operating Committee and the Advisory Committee on Export Policy.
Her practice also includes matters involving licensing services and U.S. economic sanctions, anti-boycott regulation and the Committee on Foreign Investment in the U.S. (CFIUS). She regularly assists research and development companies and universities in complying with U.S. export control laws, particularly with respect to technology transfers to foreign national researchers and students.
Notably, she teaches courses across the country on export control laws and regulations, including the International Traffic and Arms Regulations (ITAR), the Export Administration Regulations (EAR), and U.S. sanctions and embargos.
Linda’s U.S. customs practice focuses on the regulation of imports, including tariffs, country-of-origin, valuation, classification, security, transportation issues, domestic preferences and enforcement of intellectual property rights. She resolves complex free trade agreement verifications, seizures, voluntary disclosures and penalties. She has successfully pursued binding rulings, regulatory changes, protests, petitions and litigation. She also assists clients’ enforcement of exclusion orders issued by the International Trade Commission (ITC).
Linda is a member of the team assisting the Special Compliance Coordinator appointed by the U.S. Department of Commerce to monitor, assess and report on the U.S. export control compliance of Zhongxing Telecommunications Equipment Corporation, of Shenzhen, China, and ZTE Kangxun Telecommunications Ltd. of Hi-New Shenzhen, China (collectively, ZTE).
