Kristen Richer counsels and defends clients in virtually all manners of consumer-driven litigation, including pharmaceutical and medical device, product liability, mass torts, consumer class action defense and regulatory advisement.

A skilled communicator and passionate advocate for her clients, Kristen has a record of delivering creative and proactive solutions – whatever the stage of the litigation and no matter her client’s place in the product supply chain.   

With a background as a general commercial litigator, Kristen’s practice focuses on defending the manufacturers of major pharmaceutical, medical device, consumer health and beauty, and retail products in high stakes litigation.  

Kristen’s experience spans various state and federal jurisdictions, including several multidistrict litigations and coordinated proceedings across the country. Her strengths range from managing discovery, to preparing and defending fact and expert witnesses, from drafting dispositive and critical motions, to negotiating and implementing individual and mass tort settlements for her clients. 

Kristen is a proactive, strategic and pragmatic attorney. She prides herself on her ability to communicate effectively orally and in writing, build consensus and coordinate strategy across attorneys and defense teams, and facilitate client objectives efficiently and with minimal business interruption.  

Prior to joining Barnes & Thornburg, Kristen served as a law clerk to the Hon. Julio M. Fuentes in the U.S. Court of Appeals for the Third Circuit.

  • MDL Defense Liaison Counsel and counsel to several defendants against claims that in utero exposure to over-the-counter pain reliever causes autism spectrum disorder (ASD) and attention-deficit/hyperactivity disorder (ADHD)
  • Defense of a major pharmaceutical manufacturer against several thousand cases and claims alleging permanent and severe neurological and vascular injury from the use of a prescription antibiotic
  • Defense of a major pharmaceutical company and manufacturer of a diabetes medication against claims alleging injuries ranging from acute kidney injury to gangrene
  • Defense of several major national pharmacy chains against claims arising from the pharmacies’ role in dispensing an allegedly defective blood pressure medication
  • Defense of a series of cases alleging injury resulting from use of blood clot filters designed for permanent and temporary placement
  • Defense of a major pharmaceutical company against claims alleging life threatening skin reaction and tendon injury following use of a prescription antibiotic
  • Defense of consumer class actions alleging false advertising and unfair competition based on product performance and marketing of major drug-store cosmetics brand, and boutique hair and skincare companies
  • Defense of personal care brand company against class action alleging false advertising and unfair competition involving the company’s flushable wipes product line
  • Defense of a national denim brand against false advertising and unfair competition claims stemming from the brand’s “Made in the U.S.A.” labeling
  • Defense of a major food and beverage company against class action claims relating to the nutritional content of the product labeling*
