OVERVIEW

Eric Babych serves as a devoted advocate for his clients, acquiring a deep understanding of their business objectives and crafting intellectual property strategies tailored to achieving those objectives. Whether obtaining a patent that covers a crown jewel product, procuring a trademark that protects an important brand, or composing an agreement to buy, sell or license IP, Eric carefully guides his clients through complex processes to obtain broad, meaningful, and enforceable IP rights worldwide.

Eric's thorough and efficient approach, coupled with his global perspective, translates into tangible business advantages for his clients. He doesn't merely secure patents, trademarks, and other IP assets for his clients, he seeks to position them for success across the international marketplace by helping them build robust IP portfolios that block competition. He understands the competitive landscape and helps clients exploit areas of opportunity.

Eric is significantly involved with all aspects of the patent and trademark life cycles. He works closely with inventors to determine the patentable features of their innovations, prepares patent applications, interviews patent examiners, strategically manages large-volume patent estates, and guides his clients through various contentious procedures, such as oppositions, appeals, reexaminations, and invalidity trials. He also routinely performs freedom-to-operate, non-infringement, and validity/invalidity assessments.

Prior to working as an intellectual property attorney, Eric enjoyed a successful career as a medicinal research chemist at a biopharmaceutical company, where he performed multi-step organic synthesis and was named as an inventor on numerous patent applications. His experience as a medicinal chemist allows him to speak the inventors’ language, quickly grasp complex technical innovations, and translate them into commercially valuable IP assets.

Although he spends a significant amount of time counseling clients in the areas of polymer chemistry and small molecule pharmaceuticals, his experience extends beyond the chemical arts into areas such as medical devices, mechanical engineering, consumer products, sporting equipment, and analytical techniques, to name a few.
