He drafts policies and procedures, determines export classifications, advises on licensing requirements, and helps secure licenses under the International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), and Office of Foreign Assets Control (OFAC) sanctions. When potential violations arise, Nick skillfully manages disclosures to relevant authorities with a focus on minimizing risk and maintaining client trust.
On the import side, Nick helps companies review and revise their importing strategies and perform due diligence before problems arise. He advises companies on import classifications, country of origin issues, and rules of origin under the United States-Mexico-Canada Agreement (USMCA) and other trade agreements. He guides clients through the application of tariffs and related valuation and mitigation strategies, as well as forced labor laws issues and other U.S. customs issues. Nick helps clients effectively and efficiently handle prior disclosures when potential violations are unearthed.
Nick's trade remedies experience includes all phases of the process, advising during the petition and investigation, administrative and sunset reviews, and during scope ruling request proceedings. He assisted an organic chemicals company in obtaining over 400 percent combined duties on Chinese imports.
He is a member of the team assisting the Special Compliance Coordinator appointed by the U.S. Department of Commerce to monitor, assess and report on the U.S. export control compliance of Zhongxing Telecommunications Equipment Corporation, of Shenzhen, China, and ZTE Kangxun Telecommunications Ltd. of Hi-New Shenzhen, China (collectively, ZTE).
